These terms govern your use of the TLC Electrical website and app.

Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of the TLC Electrical website and the TLC Electrical iOS app (together, the “Services”), operated by TLC Electrical (operating as “Top Level Charging”, “we”, “us”, or “our”). By accessing or using the Services, or by submitting a request through them, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Services. By using the Services, you represent that you meet these requirements.
Requests and estimates are not a contract
Submitting a request through the Services does not create a contract for electrical work and does not obligate either party. Any estimate, quote, or pricing information is preliminary, provided for planning purposes, and is not binding.
Electrical work is performed only under a separate written agreement. Final scope, pricing, and timing depend on a technical review and actual site conditions. Permit approvals, utility timelines, inspections, and rebate or incentive eligibility are determined by the applicable authority, utility, or program, and are not guaranteed by us.
No professional advice
Content on the Services is provided for general informational purposes only and is not professional electrical, engineering, code-compliance, or legal advice. Electrical work should be designed and performed by a licensed professional based on your specific circumstances. Do not rely on general content on the Services in place of a technical assessment.
Acceptable use
When you use the Services, you agree to:
- Provide accurate, current, and complete information
- Use the Services only for lawful purposes and to request or manage electrical services
- Not misuse the Services, including by attempting to gain unauthorized access, interfering with or disrupting the Services, submitting false or automated requests, scraping, or introducing malicious code
- Not submit sensitive personal information (such as government identifiers, financial-account numbers, or health information) through the Services
Your submissions
You represent that information you submit is accurate and that you are authorized to provide it. You grant us permission to use the information you submit to respond to and fulfill your request, as described in our Privacy Policy. Do not submit confidential or sensitive information through the estimate form.
Intellectual property
The Services and their content, including text, graphics, logos, and the “Top Level Charging” and “TLC Electrical” names and marks, are owned by TLC Electrical or its licensors and are protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for their intended purpose. You may not copy, reproduce, distribute, or create derivative works from the Services without our prior written permission.
Third-party links and services
The Services may link to third-party websites, programs, or services that we do not control. We provide these links for convenience and are not responsible for their content, products, or practices. Your use of third-party services is governed by their terms.
Disclaimer of warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT CONTENT ON THEM IS ACCURATE, COMPLETE, OR CURRENT. ANY RELIANCE ON THE SERVICES IS AT YOUR OWN RISK.
This section applies to the website and app. It does not disclaim any warranty or obligation that applies to electrical work performed under a separate written agreement, which is governed by that agreement and applicable California law.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TLC ELECTRICAL AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).
Nothing in these Terms limits or excludes liability that cannot be limited or excluded under applicable law, including liability for gross negligence, fraud, or personal injury caused by our negligence. These limitations apply to your use of the website and app; they do not alter the rights or obligations under any separately signed agreement for electrical work, which is governed by that agreement and by California contractor law. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
Indemnification
You agree to indemnify and hold harmless TLC Electricaland its owners and employees from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your misuse of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
Dispute resolution
Please read this section carefully; it affects how disputes are resolved. Before bringing any claim, you agree to first contact us and attempt to resolve the dispute informally and in good faith for at least 30 days.
If the dispute is not resolved, you and we agree that any dispute arising out of or relating to the Services or these Terms will be resolved by binding arbitration on an individual basis, administered by a nationally recognized arbitration provider under its consumer arbitration rules, seated in Orange County, California (or conducted by telephone or video). The Federal Arbitration Act governs the interpretation and enforcement of this section.
Class-action waiver. Disputes will be resolved only on an individual basis. You and we waive any right to bring or participate in a class, collective, or representative action.
Exceptions and opt-out.Either party may bring a qualifying claim in small-claims court. You may opt out of this arbitration and class-waiver agreement by sending us written notice within 30 days of first accepting these Terms; if you opt out, the “Governing law and venue” section below applies to disputes instead.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. To the extent a dispute is not subject to arbitration, it will be brought exclusively in the state or federal courts located in Orange County, California, and you consent to personal jurisdiction there.
Suspension and termination
We may suspend or terminate your access to the Services at any time if you violate these Terms or misuse the Services. You may stop using the Services at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.
Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Services after an update takes effect constitutes acceptance of the updated Terms.
Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and TLC Electrical regarding the Services. If any provision is found unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
